What does a disability lawyer do?
A disability lawyer represents you in your SSDI or SSI claim — gathering medical evidence, filing forms and appeals, and arguing your case before Social Security at every level: initial application, reconsideration, ALJ hearing, Appeals Council, and federal court if needed.
How much does a disability lawyer cost?
Nothing upfront. Federal law caps the fee at 25% of your back pay or $9,200, whichever is less. The fee is paid by SSA directly out of back pay only if we win. Minor records fees may apply and are disclosed in writing first.
When should I hire a disability lawyer?
As early as possible — ideally before you file, but at minimum the moment you receive a denial. Strong evidence built early shortens the case and increases the chance of approval at the lowest level.
What's the difference between SSDI and SSI?
SSDI is for workers with enough work credits whose condition prevents substantial work. SSI is need-based for low-income individuals with disabilities, regardless of work history. Many people qualify for both.
How long does SSDI take to get approved?
Typically 3–6 months for an initial decision. If you're denied and appeal to an ALJ hearing, expect 12–24 months depending on your region's hearing office backlog.
What conditions qualify for disability?
Hundreds — physical and mental. SSA's "Blue Book" lists qualifying conditions, but you can also qualify by medically equaling a listing or by proving your combination of impairments prevents any substantial work. See the conditions list above for examples.
Can I work and still get disability?
Limited work below the SGA earnings limit (~$1,620/mo non-blind in 2026) is allowed. Working above that level usually disqualifies you. Trial work periods exist after approval.
How much will my disability check be?
SSDI is based on your lifetime earnings record — most checks fall between $1,300 and $3,800/mo. SSI has a federal max ($943/mo individual in 2024) but most states add a small supplement.
What's "back pay" and how much can I get?
Back pay covers benefits owed from your disability onset date (less a 5-month waiting period for SSDI) through the date of approval. For long-pending cases, back pay can be tens of thousands of dollars.
My claim was denied — what now?
You have 60 days to file a Request for Reconsideration. Don't refile a new application — appeal the denial. That's where a lawyer makes the biggest difference.
Do I have to go to court?
If your case advances to an ALJ hearing, yes — but it's not "court" in the dramatic sense. It's an informal hearing with a judge, you, your lawyer, and sometimes a vocational expert. Held by video, phone, or in person.
